The Senate will vote on Monday on Andrew Hurwitz, President Obama’s pro-abortion nominee to the U.S. Circuit Court of Appeals for the Ninth Circuit.
Obama added to his pro-abortion record by placing yet another abortion activist in nomination to a top federal appeals court — this time a lawyer credited with helping craft the Roe v. Wade decision. He appointed Hurwitz to the 9th Circuit Court, the most liberal appeals court in the country based in San Francisco and covering laws approved in western states.
The Senate Judiciary Committee voted 13-5 in March to approve Hurwitz as a candidate for a vacancy on the appeals court. Now his nomination heads to the full Senate, which will decide whether to invoke cloture on the nomination.
Hurwitz was instrumental to providing some of the legal framework for Roe, which resulted in 54 million abortions. In a law review paper published in 2002, Hurwitz takes partial credit for drafting opinions as a law clerk that the Supreme Court would later use to frame its landmark decision in Roe v. Wade.

When Roe v. Wade was decided, Hurwitz was only 26, barely out of law school and in his
first year of clerking for Supreme Court Justice Stewart. I think that it’s an exaggeration
to say he helped craft Roe v. Wade– to say he was there when the decision was made is
probably closer to the mark.
What do we know of the opinions he has authored in the subsequent 40 years of his legal
career?
But it is telling that he should attempt to claim some of the ‘credit’ for the decision … just as it is telling that President Obama should have nominated a man who would claim such ‘credit’ …
To help clarify–My husband was a law clerk for a 9th Circuit appeals court judge umpteen years ago, so I asked him about this. When asked if law clerks wrote a large part of the opinions he said yes–but they generally wouldn’t take credit for it. It’s a process–they write first drafts, it goes back and forth, the judge signs it; but a significant amount of the language that ends up in the opinion was written by the clerks. (I have to say my husband doesn’t brag about his accomplishments, which are many.) So–not having read the law review paper Mr. Hurwitz wrote, I don’t know how he phrased it, or whether he took too much credit for the decision. And I don’t know anything about him or his subsequent legal career, so I can’t speak to that.
Just another reminder why your vote for president matters. The POTUS makes lifetime appointments to the federal bench.
And remember, if you don’t live in a swing state, you’re morally obligate to move to one so that your vote will really matter!
I have a correction to your post, Father. Here out west the proper name for this court is the 9th CIRCUS Court.
It is staggering how someone like Obama has such little regard for his soul. Obama and those like him must figure that either there is no life other than this one or he believes all things are forgiven and everyone will enter Heaven regardless of their works. It is beyond tragic how many unborn children have been given the death sentence since the demonic law legalizing abortion passed in this country. May Our Lord bless all children, especially the little ones he has knit together in their mothers’ wombs. +JMJ+

Not if all viable candidates support abortion to one extent or another. Yes, even those who are ‘personally against abortion’ but are happy to remain silent on the issue and not rock the boat. Then who you vote for is entirely irrelevant. You might as well not show up…
